Distance Sales Agreement – Cerre Diamond

This Distance Sales Agreement has been prepared in accordance with relevant laws and regulations, including Turkey’s Consumer Protection Law and Regulation on Distance Contracts. By placing an order on our website, you agree to the terms and conditions outlined in this agreement.

This agreement is entered into between the buyer (referred to as “Customer”) and Cerre, the seller, in a digital environment where both parties do not meet physically. The agreement covers the sale and delivery of goods or services through the Cerre Diamond website.

1. Parties
Seller:
Cerre Diamond – an e-commerce platform operated from Istanbul, Turkey.

Buyer:
The individual who places an order on the Cerre Diamond website and completes the checkout process using their personal information.

2. Subject of the Agreement
The subject of this agreement is the rights and obligations of the parties in accordance with the provisions of the Law on the Protection of Consumers and the Regulation on Distance Contracts, in relation to the sale and delivery of goods or services that the buyer orders electronically through Cerre Diamond online platform.

3. Product Information
Details such as product description, price (including taxes), payment terms, delivery information, and return conditions are presented clearly on the website during the checkout process and form an integral part of this agreement.

The buyer confirms that they have reviewed and understood this information before placing an order.

4. Delivery Conditions
Cerre Diamond will prepare and dispatch the order within 1–3 business days unless otherwise specified. Delivery times vary depending on the buyer’s location. Orders are shipped using contracted logistics partners.

Cerre Diamond is not responsible for any delays caused by customs or courier services. Risk of loss or damage to the product passes to the buyer once the product has been delivered to the shipping address provided during the order.

5. Payment
Payments can be made using available methods displayed on the website (credit card, debit card, third-party payment gateways, etc.). Prices and currencies are clearly indicated. Once payment is confirmed, an order confirmation email is sent.

Cerre does not store or access any sensitive payment information. All transactions are processed through secure, PCI-compliant systems.

6. Right of Withdrawal
The buyer has the right to withdraw from this agreement within 14 days of receiving the product, without providing any reason or incurring any penalties.

To use this right, the buyer must notify Cerre in writing through the Contact Us page. The product must be returned unused, undamaged, and in its original packaging with all labels and tags intact. The cost of return shipping is the responsibility of the buyer unless the item is defective or incorrect.

Cerre will inspect the returned product and issue a full refund to the original payment method within 10 business days, if all conditions are met.

7. Products Not Eligible for Withdrawal
Withdrawal rights do not apply to the following:

Custom or personalized items

Products that are used, damaged, or altered after delivery

Items that are non-returnable for hygiene reasons (e.g., swimwear, undergarments)

Digital content that has already been downloaded or accessed

8. Seller’s Rights and Responsibilities
Cerre is responsible for delivering the ordered product in accordance with the specifications stated on the website and under the terms of this agreement. In cases where the product becomes unavailable or cannot be supplied, Cerre Diamond will inform the buyer and refund the payment in full.

9. Buyer’s Responsibilities
The buyer agrees to provide accurate and up-to-date information during the order process. The buyer is responsible for receiving the order at the specified address and for any additional duties, customs fees, or local taxes applicable in their country.

10. Dispute Resolution
Any disputes arising from this agreement will first be attempted to be resolved through mutual communication. If no resolution is achieved, disputes will be referred to Istanbul Consumer Arbitration Committees or the courts of Istanbul, as legally applicable.

11. Force Majeure
Cerre is not liable for any delay or failure in performance caused by events beyond its control, including but not limited to natural disasters, pandemics, wars, or disruptions in internet or communication services.

12. Final Provisions
By confirming your order, you acknowledge that you have read, understood, and accepted the terms of this Distance Sales Agreement. A digital copy of this agreement is stored and accessible through your order history on the website.
